Half-Day Sessions:
Consist of five (5) hours inclusive of review and preparation time.
Full-Day Sessions:
Consist of ten (10) hours inclusive of review and preparation time
A minimum of 4 hours is generally required. The average case usually takes from 4-8 hours, depending on subject matter, nature of the case, parties involved, representative attorneys, etc.
Rarely. Depending on the circumstance, a case may be accepted for less than 4 hours, but it is generally not recommended. These circumstances might include: A gross value of less than $25,000, admitted liability, uncomplicated issues, and Settlement Days.

Mr. Brenner has many areas of expertise and is comfortable handling almost any subject matter with the exceptions of: Divorce and very complicated intellectual property matters. Please see the Areas of Expertise page for more information.
Mr. Brenner employs a vast variety of mediation styles and techniques depending upon the particular case, personalities involved, and subject matter. Although Mr. Brenner tends toward a more evaluative style of mediation, he uses a facilitative approach when appropriate.
Length varies from case to case. A very small case can sometimes be mediated in 2 hours or less. Larger cases require a minimum of a 1/2 day and full day sessions may be warranted.
Briefs are not required, but highly recommended. They are called “briefs” for a reason. A summary of facts, liability, damages, and a discussion of applicable law is usually sufficient. If the case is complex or involves complicated legal issues, a lengthier brief is acceptable. Please keep in mind that I diligently reads all briefs and exhibits prior to Mediations. Having been a litigator, I know how difficult it is to get briefs done in advance of the mediation. Submitting a brief the day before the mediation is fine, although the earlier it can be submitted, the more time I have to review it in detail and call you with any questions.
